These Terms & Conditions ("Terms") form a binding agreement between you and Kingdom Kratom, a brand owned and operated by FYE LLC ("Kingdom Kratom," "we," "us," or "our"). They govern your access to and use of shop.kingdomkratom.com and any related services (collectively, the "Site").

BY ACCESSING THE SITE, PLACING AN ORDER, OR USING ANY PRODUCT SOLD BY KINGDOM KRATOM, YOU AFFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE USE OF THE SITE AND REFRAIN FROM PURCHASING ANY PRODUCT.

These Terms incorporate by reference our Privacy Policy, Shipping Policy, Refund Policy, Disclaimer, and Anti-Spam Policy.

1. Age Requirement & Eligibility

You represent and warrant that you are at least twenty-one (21) years of age and that the possession and purchase of kratom (Mitragyna speciosa) is lawful in your jurisdiction. Individuals under 21 are strictly prohibited from using the Site or purchasing any product.

We reserve the right to request government-issued photo identification at any time and to cancel any order if age or eligibility cannot be satisfactorily verified.

2. Account Registration & Buyer Representations

If you create an account, you agree to:

  1. Provide accurate, current, and complete information.
  2. Maintain and promptly update your account information.
  3. Maintain the security and confidentiality of your account credentials.
  4. Accept responsibility for all activities that occur under your account.

By placing an order, you further represent and warrant that:

  • You are purchasing for your own personal, lawful, adult use.
  • You are not purchasing on behalf of a minor or any person residing in a restricted jurisdiction.
  • You are responsible for understanding and complying with the laws of your local jurisdiction concerning the purchase, possession, and use of kratom.
  • You assume full responsibility for any consequences of your purchase, possession, and use of our products.

3. Address Verification & Fraud Prevention

To protect against fraud and chargebacks:

  • The billing address you provide must match the address on file with your bank or card issuer.
  • Orders flagged by our fraud-prevention systems may require additional verification before shipment, including a brief phone call or a copy of your photo ID.
  • We may decline any order at our sole discretion.
  • Third-party purchases are prohibited — you may not purchase products for delivery to a third party who has not personally agreed to these Terms and confirmed they are 21 or older. Gifts to known friends or household members aged 21+ are permitted; bulk delivery to others is not.

4. Payment Terms

  • All prices are listed in U.S. dollars (USD) and are exclusive of applicable taxes, which are calculated and displayed at checkout.
  • We accept payment methods listed at checkout, which may include credit/debit cards, ACH, buy-now-pay-later providers (such as Sezzle and Affirm), and digital wallets (such as Google Pay, Apple Pay, Amazon Pay).
  • All payments are processed by PCI-compliant third-party payment processors. We do not store your full card number on our systems.
  • Orders are not considered complete until funds have cleared and the order has shipped.
  • Pricing is subject to change without notice. Errors or omissions in pricing may result in cancellation of affected orders.

5. Shipping & Delivery

Full shipping terms are set out in our Shipping Policy. Key points:

  • We ship to addresses within the United States only. We do not ship to PO Boxes, APO/FPO/DPO, U.S. territories, or international destinations.
  • Orders placed before 1:00 PM Central Time on a business day ship the same day; later orders ship the next business day.
  • Free standard shipping on U.S. orders of $75 or more.
  • Risk of loss passes to you upon delivery confirmation by the carrier.

6. Returns, Refunds & Cancellations

Full return terms are set out in our Refund Policy. Key points:

  • Returns must be requested within 30 days of delivery and require a pre-authorized Return Merchandise Authorization (RMA) number.
  • Unopened items in original packaging are refundable in full (minus return shipping for standard returns).
  • Opened items are refundable only if at least 50% of the original product remains, limited to one opened item per order.
  • Damaged or defective items are eligible for full replacement or refund (including original shipping) — photo evidence required within 7 days of delivery.
  • Subscription orders (if available) require a minimum of two billed shipments before cancellation.

7. Product Disclaimer

These products and any statements made about them have not been evaluated by the United States Food and Drug Administration. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Kratom may be habit-forming; prolonged daily use can lead to physical dependence and withdrawal symptoms. Kratom may interact with prescription medications, alcohol, opioids, sedatives, or stimulants. Do not use if you are pregnant, nursing, under 21, or have any medical condition without first consulting a licensed physician.

8. Adverse Event Reporting

If you experience any adverse health event after using a Kingdom Kratom product:

  1. Stop use immediately and seek medical attention if needed.
  2. Notify us at info@kingdomkratom.com with your order number, the affected product, lot number (if available), and a description of the event.
  3. You may also report adverse events directly to the FDA through the MedWatch program at www.fda.gov/safety/medwatch or by calling 1-800-FDA-1088.

We take adverse-event reports seriously and will respond promptly. Reporting an adverse event does not waive any of your rights under these Terms or applicable law.

9. Suggested Use

Follow the suggested serving size printed on each product's label. Exceeding the recommended serving is done at your own risk. We do not recommend daily prolonged use of kratom. See the Disclaimer for our full Suggested Use guidance.

10. Geographic & Shipping Restrictions

We do not ship to any jurisdiction where kratom is illegal or subject to prohibition. As of the last updated date above, this includes:

Restricted states: Alabama, Arkansas, Indiana, Louisiana, Mississippi (effective July 1, 2025), Rhode Island, Vermont, Wisconsin.

Restricted cities and counties: Denver, Colorado; Jerseyville, Illinois; Alton, Illinois; San Diego, California; Oceanside, California; Sarasota County, Florida; Columbus, Mississippi; Malheur County, Oregon.

This list is subject to change without prior notice as new regulations take effect. Orders placed for delivery to a restricted location will be cancelled and refunded at the original payment method, less any processing fees.

11. Right to Refuse Service

We reserve the right to refuse, cancel, or modify any order at our sole discretion for any lawful reason, including but not limited to:

  • Suspected fraud, chargeback risk, or address mismatch
  • Inability to verify age or eligibility
  • Order destinations in restricted jurisdictions
  • Suspected resale or commercial redistribution without our authorization
  • Customer behavior that violates these Terms

Cancelled orders are refunded in full at the original payment method.

12. Intellectual Property

All content on the Site — including text, graphics, logos, images, product photographs, packaging design, the "Kingdom Kratom" name and mark, and all other proprietary content — is owned by or licensed to FYE LLC and is protected by U.S. and international copyright, trademark, and other intellectual-property laws.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site without our prior written consent. Limited personal, non-commercial use (such as bookmarking a product page or printing an order receipt) is permitted.

13. User Content & Reviews

If you submit a product review, testimonial, comment, photograph, or any other content to the Site ("User Content"):

  • You grant Kingdom Kratom a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, and display the User Content in any media, including for marketing purposes.
  • You represent that the User Content is your own original work, does not infringe any third-party rights, and complies with our content guidelines.
  • We reserve the right to remove or refuse to publish any User Content at our sole discretion.
  • User Content must not contain medical claims, references to using kratom for the treatment of any disease, or references to using kratom in combination with other substances.

14. Prohibited Uses

You agree not to:

  • Use the Site or our products for any unlawful purpose
  • Violate any federal, state, or local law in connection with your use of the Site
  • Resell or commercially redistribute our products without our prior written consent
  • Use the Site to harass, abuse, defame, or threaten others
  • Attempt to gain unauthorized access to any part of the Site, our systems, or other users' accounts
  • Use automated tools (bots, scrapers, crawlers) to collect data from the Site, except as permitted by our robots.txt
  • Reverse-engineer, decompile, or attempt to extract the source code of any software on the Site
  • Interfere with or disrupt the operation of the Site or its servers

Violation of any of the above is grounds for immediate termination of your account and may result in civil or criminal liability.

15. Third-Party Links

The Site may contain links to third-party websites or services we do not control. We are not responsible for the content, accuracy, or practices of any third-party site. Your interactions with any third-party site are subject to that site's terms and privacy policy.

16. Warranty Disclaimer — AS-IS

ALL PRODUCTS ARE SOLD STRICTLY "AS-IS" AND "WITH ALL FAULTS." Except as expressly stated in the Refund Policy, we make no warranties of any kind — express, implied, statutory, or otherwise — including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, safety, purity, or efficacy.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions may not fully apply to you.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  1. Kingdom Kratom, FYE LLC, and their officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to damages for personal injury, illness, addiction, withdrawal, drug interactions, lost profits, lost data, or business interruption — arising out of or related to your purchase, possession, or use of any product or the Site.
  2. In no event shall the total liability of Kingdom Kratom or FYE LLC exceed the amount you actually paid for the specific product giving rise to the claim.
  3. The limitations in this Section apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
  4. Some jurisdictions do not allow the exclusion of certain damages or the limitation of liability for personal injury; in those jurisdictions, the above limitations apply only to the maximum extent permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Kingdom Kratom, FYE LLC, and their officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of any product or the Site
  • Your violation of these Terms
  • Your illegal purchase, possession, or use of any product
  • Your failure to comply with applicable laws
  • Your disregard of any warnings provided in these Terms, in our Disclaimer, or on product labeling
  • Any User Content you submit to the Site
  • Any third-party claim arising from your conduct

This indemnification obligation survives termination of your account and these Terms.

19. Dispute Resolution & Arbitration

Please read this Section carefully — it affects how disputes are resolved between you and Kingdom Kratom.

19.1 Informal Resolution

Before initiating arbitration, you agree to first attempt to resolve any dispute informally by contacting info@kingdomkratom.com with a written Notice of Dispute describing the nature of the dispute and your requested relief. We will attempt to resolve the dispute in good faith within 60 days of receiving the Notice. Arbitration may be initiated only if the dispute is not resolved within that period.

19.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with the arbitration to take place in San Antonio, Texas (or, at your election, by telephonic or video hearing). The arbitrator's decision is final and binding.

19.3 Class Action Waiver

YOU AND KINGDOM KRATOM EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Disputes must be brought on an individual basis only. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.

19.4 Jury Trial Waiver

You and Kingdom Kratom each waive the right to a trial by jury with respect to any claim arising out of these Terms or our products, subject to the arbitration agreement above.

19.5 30-Day Right to Opt Out of Arbitration

You may opt out of the arbitration and class-action-waiver provisions in this Section 19 by sending a written notice to info@kingdomkratom.com with the subject line ARBITRATION OPT-OUT within 30 days of your first order. The notice must include your full name, mailing address, and the order number of the first order placed on the Site. If you opt out, neither you nor Kingdom Kratom will be bound by the arbitration provisions, but the other Terms (including the class-action waiver to the extent permitted by law) will remain in effect.

19.6 Exceptions

The arbitration provisions in this Section do not apply to:

  • Claims for injunctive relief to protect intellectual property
  • Small-claims-court actions filed in the claimant's local jurisdiction
  • Claims that cannot lawfully be required to be arbitrated under applicable consumer-protection law

19.7 Attorneys' Fees

The prevailing party in any arbitration or litigation related to these Terms shall be entitled to recover its reasonable attorneys' fees and costs.

20. Governing Law & Venue

These Terms and any dispute arising under or relating to them are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. For any claim not subject to arbitration under Section 19, the exclusive jurisdiction and venue is the state and federal courts located in Bexar County, Texas.

21. Force Majeure

We shall not be liable for any delay or failure in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, pandemic or epidemic, war or civil unrest, government action, carrier disruptions, supply-chain interruptions, internet or utility outages, or cyberattacks.

22. Modifications to These Terms

We reserve the right to modify these Terms at any time. The revised version will be posted on the Site with an updated "Last updated" date. Material changes will be flagged at the top of the page for at least 30 days. Your continued use of the Site or placement of an order after a change constitutes your binding acceptance of the revised Terms.

If you do not agree to a change, you must stop using the Site and refrain from placing any further orders.

23. Severability

If any provision of these Terms is held invalid, unenforceable, or contrary to law by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

24. Entire Agreement

These Terms (together with the Privacy Policy, Shipping Policy, Refund Policy, Disclaimer, Anti-Spam Policy, and any other policies referenced herein) constitute the entire agreement between you and Kingdom Kratom with respect to your use of the Site and supersede any prior agreements, representations, or understandings.

25. Electronic Communications & Signatures

By using the Site, you consent to receive communications from us in electronic form (including by email, SMS where opted in, and posting on the Site). You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

Pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN), you affirmatively consent to the use of electronic signatures in your dealings with Kingdom Kratom.

26. Assignment

You may not assign these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, financing, or sale of assets.

27. No Waiver

Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or any other provision.
