Kingdom Kratom (operated by FYE LLC) operates shop.kingdomkratom.com (the "Site") and takes commercial-email integrity seriously. This page explains (1) what you may not do with our Site, our email addresses, or any data you may collect from the Site; (2) what we commit to doing with your information; and (3) how to report any communication you believe to be sent in our name without authorization.
1. Restrictions on Use of Our Services
You may not use the Site, our customer database, our published email addresses, our SMS short code, or any data collected from any of the above to:
- Collect, harvest, scrape, compile, or otherwise obtain email addresses, phone numbers, or other personal information about our customers or visitors
- Send unsolicited commercial email ("spam"), unsolicited SMS messages, or unsolicited automated calls to any customer, visitor, or any other person
- Use our brand name, logo, or contact information to lend legitimacy to any commercial communication you send
- Operate any mailing list, contact-mining tool, or scraping bot against the Site
- Use our customer-service email addresses for promotional, marketing, or solicitation purposes
These restrictions apply to all visitors, customers, and any third party with access to any data originating from the Site.
2. No Right to Send Email or SMS on Our Behalf
No purchase, account creation, newsletter signup, or interaction with the Site grants you any right to send commercial email, SMS, or automated calls on behalf of Kingdom Kratom or FYE LLC, or to represent that you are affiliated with, endorsed by, or authorized by Kingdom Kratom or FYE LLC.
Any commercial communication using the Kingdom Kratom name, logo, domain, or branding that was not sent by us or by a vendor we have explicitly authorized in writing is unauthorized and a violation of this policy.
3. Enforcement & Account Termination
Kingdom Kratom reserves the right to immediately terminate any customer account, refuse to fulfill any order, and block any IP address or device that we reasonably determine has engaged in, attempted, or facilitated any activity prohibited under Sections 1 or 2.
We further reserve the right to:
- Refer suspected violations to law enforcement, the Federal Trade Commission (FTC), or state attorneys general
- Pursue civil remedies against violators, including injunctive relief and statutory damages
- Share information about violations with industry abuse-tracking services
Termination of an account does not entitle the account holder to a refund of any product fees or membership fees.
4. Legal Consequences for Violators
Sending unsolicited commercial email may violate the CAN-SPAM Act of 2003 (15 U.S.C. §§ 7701–7713) and applicable state anti-spam laws. Violators may be subject to:
- Civil penalties assessed by the Federal Trade Commission, currently up to the per-violation maximum periodically adjusted for inflation
- Cease-and-desist orders issued by federal or state authorities
- Criminal prosecution under 18 U.S.C. § 1037 for egregious offenders, with possible penalties including fines, forfeiture of property, and imprisonment
- Private civil action by internet service providers harmed by the spam
Sending unsolicited commercial text messages or automated calls may further violate the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227), which provides for statutory damages of $500 to $1,500 per unauthorized message or call.
Kingdom Kratom will fully cooperate with any law-enforcement investigation into violations of either statute.
5. Our Own Commitments (CAN-SPAM Compliance)
When we send a commercial email — for example, a promotional newsletter, a discount-code announcement, or a back-in-stock notice — we commit to all of the following:
- We only send commercial email to addresses that have affirmatively opted in through a signup form on the Site, a checkout-time opt-in checkbox, or a written request to our customer-service team.
- Every commercial email contains a clear "From" identification of Kingdom Kratom or FYE LLC.
- Every commercial email contains a truthful subject line that accurately describes the content.
- Every commercial email contains a clear and conspicuous unsubscribe link at the bottom.
- Unsubscribe requests are processed within 10 business days, in practice usually within minutes.
- We do not sell or rent our email list to any third party.
- Transactional emails (order confirmations, shipping notices, RMA confirmations, refund confirmations) are sent regardless of marketing-opt-in status and cannot be unsubscribed from while you have an active order or open case with us.
If you receive a commercial email from us that does not meet the above standards, please report it to info@kingdomkratom.com so we can investigate.
6. SMS and Text Messaging (TCPA Compliance)
Our SMS program is opt-in only. You will only receive text messages from Kingdom Kratom if you have:
- Provided your mobile number at checkout AND ticked the SMS-opt-in checkbox, or
- Texted a keyword (such as "JOIN") to our short code, or
- Signed up for SMS on a clearly labeled form on the Site.
Message frequency: Up to 8 messages per month. Message and data rates may apply.
To opt out: Reply STOP to any message from us. You will receive one final confirmation message and no further SMS until you re-opt-in.

Mobile carrier disclaimer: Mobile carriers (Verizon, AT&T, T-Mobile, etc.) are not liable for delayed or undelivered messages.
Privacy: We will not sell, rent, or share your mobile number with any third party for marketing purposes. See our Privacy Policy for full details on data handling.
7. How to Unsubscribe
You may opt out of any commercial communication at any time:

Opt-out requests are honored within 10 business days (legal maximum under CAN-SPAM is 10 business days; in practice ours are processed within minutes).
Note: Opting out of marketing communications does not opt you out of transactional emails related to active orders, returns, or customer-service interactions.
8. Reporting Spam Sent in Our Name
If you receive an unsolicited email, SMS, or call that appears to come from "Kingdom Kratom" or "shop.kingdomkratom.com" and you did not opt in to receive communications from us:
- Do not reply or click any links in the suspect message.

SUSPECTED SPAM. - If the message claims to be from a Kingdom Kratom employee asking for personal information, payment, or login credentials, do not provide them — we will never request login credentials, full payment details, or government-ID numbers via email or SMS.
We investigate every report. Confirmed spoofed messages are referred to the FTC's spam-reporting database (spam@uce.gov) and to relevant carrier abuse desks. You can also report directly to the FTC at reportfraud.ftc.gov.
9. Changes to This Policy
We may update this policy from time to time to reflect changes in our practices, applicable law, or industry standards. The revised version will be posted on this page with an updated "Last updated" date.
